Considering the position, and how this isn't a duel to the death (though even if someone did die in it, it's not like it would matter), scholar is the victor.
However if you can some how realistically get out of that position Sparking, I'll let it continue.

From the blows that came towards him he found that the best thing to do was side step them completely, so with one swinging motion he sidestepped the pole and brought the Katana to his neck. Regardless of weather or not he had cut his throat he could have. Thus he was the one who won this, or at least he knew it. Having not actually touched sparking he could still slice at his ribs, or punch him in the stomach who knows what would happen for this position is vulnerable. But he could have won, if this was to the death. He prays that his opponent too realizes this and stops. For they are both exhausted or should be. Since his foe hesitated, Hasshi tried a desperate manuver and crouched and initiated a forward roll, as he was rolling forward, Hasshi instinctly swung his pole to his far right, whether he he hit his foe he didn't know all he could think about was rolling forward to escape his foe's blade.

Having no evidence that Suehiro was ever on the right side that he started to slice his back pretty quickly. Weather or not he could get away in a crouching position with his poll on the wrong side depends on how accurate the strike to his spin would be to either sever it completely or only cause immense pain. With both hands and swift and graceful movements, like a chainsaw being the Katana and the felled log being Hasshi's spine. (But how fast would it take for a desperate man to get into a roll while swinging his pole to the right of him, or how fast it is to move a katana from the neck to any area on the spine when he starts to roll...? Truthfully I don't want to kill him, I mean seriously this is a no fatality zone... I mean that's the requirement filled out in the beginning. So how will this work?)

If you had 'killed' me, we would have just taken it as you 'wounded' me. Also, if my pole was indeed still facing north, and you moved to your left (which i think is what Baiko said) i'd have to swing my pole to my right. It still works out the other way though, just change right to left. Ultimately though, that's not the point, i swung the pole while i was rolling, and it's quite likely the sweep missed you entirely. Wherther you win or not is really dependant on your reaction time. ie. did you cut me before i could roll, or did i roll before you could cut me? PS maybe you should use a Basho next time then?

If you had 'killed' me, we would have just taken it as you 'wounded' me. Actually we would have taken it that you died, but seeing as how this area is essentially another dimension, it wouldn't affect anything.

Since when did scholar have a blade at my throat?, he simply pointed a blade at my neck, there's a difference. "Having not actually touched sparking " Now, i know he did't touch 'sparking' at all cause he isn't dueling sparking, i'm sure if you asked him, he'd say he meant Hasshi when he said sparking, and that he just got sick of saying 'Butterfly Man'

Tadakatsu had quite enough of this display of novice stickfighting.
When you two are done dancing around come find me, watching the two of you is hurting my eyes! Tadakatsu yelled over to the pathetic duelists.
Annoyed, he left the now upturned garden and entered the Inn. He had enough of this.

And his blade is not at my throat, he said neck, if it was aimed at my throat, even if it wasn't actually touching it, i'd be commiting suicide by doing a forward roll, i'm not stupid you know. Since Scholar's blade is not touching my neck, and our stats are identical, i think that it's plausable that Hasshi could escape and continue on with the duel. However it's also plausable that scholar could cut me while i try to escape, it looks like i'll have to reach some kind of agreement when scholar gets on as to what the verdict is.

someone flip a coin. Heads I win, tails he escapes and this is over with. What do you say sparky? Baiko? Aaron? This is starting to get... well... embarrassing. This was supposed to be fun. But sparky feels cheated, Baiko says there was no cheating, and Aaron supports Baiko. But in the end... this doesn't really matter. So, someone with a coin flip it or I will... well that threat doesn't work it needs to be a mod.

Seeing as this has got out of hand, and seeing as scholar did have his sword at your throat. (Neck, throat, it's all pretty much the same thing.) Not to mention he wrote that he could cut your throat in the position you were in.
Realistically, rolling forewords, all he would need to do is move his sword ever so slightly downwards and your neck would be severed off. Seeing as how you don't want to die (although like I said before, deaths in this board don't actually count), Sparking's character is wounded, scholar wins the duel and the services of Honda Tadakatsu as well as 400 gold.
